1. Acceptance of Terms
By accessing or using mklogo ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Service Description
mklogo is an AI-powered logo generation tool that takes text prompts, expands them using large language models, generates logo images using AI image generation models, and provides optional conversion to SVG and branding asset bundles. The Service processes your inputs through third-party AI APIs including Google (Imagen) and Anthropic (Claude).
3. User Responsibilities & Intellectual Property
You are solely and exclusively responsible for ensuring that any logos, branding assets, or other content generated through the Service do not infringe upon any existing trademarks, copyrights, or other intellectual property rights of any third party.
AI models are trained on large datasets and may inadvertently produce content that bears resemblance to existing trademarks, logos, or copyrighted works. This resemblance may be coincidental or a result of patterns in the model's training data. The Service does not perform any trademark searches, IP clearance checks, or infringement analysis on generated outputs.
By using the Service, you acknowledge and agree that:
- You must conduct your own comprehensive trademark and intellectual property searches before using any generated content for commercial purposes
- You should consult with a qualified intellectual property attorney before registering or commercially deploying any generated logos or branding
- The Service provides no warranty of non-infringement and makes no representations that generated content is free of third-party IP claims
- You assume all risk and liability associated with the use of generated content, including any claims of trademark or copyright infringement
- The Service does not provide legal advice of any kind regarding trademarks, copyrights, or intellectual property
4. Generated Content
All content generated through the Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory. We make no warranties regarding the accuracy, quality, completeness, originality, or fitness for a particular purpose of any generated content.
We do not store your prompts, generated images, or any other content you create through the Service. Once generated content is delivered to your browser, it exists only on your device. We have no access to, control over, or responsibility for content after it leaves our servers.
5. Ownership of Generated Content
Subject to these terms and the rights of any third parties, you may use content generated through the Service for any lawful purpose, including commercial use. However, you acknowledge that:
- AI-generated content may have limited or no copyright protection under current law in many jurisdictions
- Ownership rights are subject to the intellectual property rights of third parties whose works may have been part of AI model training data
- Multiple users may receive similar or identical outputs for similar prompts
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MKLOGO AND ITS OPERATORS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or business opportunities
- Loss of goodwill or reputation
- Costs of procurement of substitute goods or services
- Claims of intellectual property infringement by third parties
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid for the Service in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).
7. Indemnification
You agree to indemnify, defend, and hold harmless mklogo and its operators from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service or any generated content
- Your violation of these terms or any applicable law or regulation
- Any claim that content you generated through the Service infringes the intellectual property rights of a third party
- Any dispute between you and any third party regarding generated content
8. Acceptable Use
You agree not to use the Service to:
- Generate content that is illegal, harmful, threatening, abusive, or otherwise objectionable
- Intentionally generate content that infringes known trademarks, copyrights, or other intellectual property rights
- Impersonate any person or entity, or falsely represent affiliation with any organization
- Attempt to reverse-engineer, decompile, or extract the underlying models or algorithms
- Use the Service in any manner that could disable, overburden, or impair its operation
9. Third-Party Services
The Service relies on third-party AI providers to generate content. Your use of the Service is also subject to the terms and policies of these providers. We are not responsible for the availability, performance, or output quality of third-party services.
10. Modifications to Terms
We reserve the right to modify these terms at any time. Material changes will be indicated by updating the effective date at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of the modified terms.
11. Governing Law
These terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these terms or your use of the Service shall be resolved in a court of competent jurisdiction.
12. Severability
If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.
